About Paul Welten
Paul Welten is an attorney-at-law and partner at AKD who specialises in construction law. The UAV-GC 2005, the UAV 2012 (RAW/STABU) and the DNR 2011 (revision 2013) general conditions used in the construction industry are his particular areas of expertise.
His practice also encompasses contracting, advising and litigating. In addition, Paul specialises in construction team agreements, whether or not in combination with UAV(GC) conditions. He is closely familiar with the UAV-GC 2025 uniform administration conditions for integrated contracts as well.
He specialises in disputes that in substantive and legal terms are hugely expansive and highly complex, which may also involve other factors, such as political issues and technical and/or financial aspects. He has a particular affinity for disputes over construction delays and related claims from both sides to the contract.
Paul often advises government clients (such as municipalities, water boards and healthcare and educational institutions), assisting them in legal proceedings if necessary. His clients also include contractors and principals.
On 15 March 2021, he participated in the Expert Meeting of the Netherlands Institute for Construction Law (Instituut voor Bouwrecht) in the preliminary phase of the review of the UAV-GC. Paul organises ‘UAV-GC 2025 knowledge-sharing sessions’, in which he addresses:
- responsibility for documents issued in the tender/contract;
- justified or unjustified ‘assumptions’ by contractor/principal;
- responsibility for soil conditions in particular;
- risks and opportunities for ‘compensation’ and/or ‘deadline extension’;
- requests for change versus ‘compensation’ and procedures to be followed;
- limitations of liability under the UAV-GC 2025.
